Returns Policy
Please choose carefully when shopping at Next Byte. Be sure to check the system requirements before purchasing. Our sales consultants will be happy to match a solution to your needs.
Refunds and exchanges will be provided in line with your rights as a consumer and the additional policies and warranties summarised below. We will normally only refund in the event the goods:
- are of unacceptable quality (eg. due to a defect);
- are unfit for a purpose that you disclosed to us; or
- do not match the description by which they were sold; or
- where otherwise required by statute.
Refunds will not be provided if you simply change your mind.
In some circumstances, we may need to send the item to the manufacturer for assessment to determine whether or not you are entitled to an exchange, refund or repair.
If we accept merchandise for return that does not fall into any of the above categories, we may charge a 15% restocking fee if the goods have been opened, or the packaging is damaged.
We recommend that you retain your proof of purchase.
Configure to Order (CTO) Products & Customer Specific Orders (CSO)
Next Byte strongly encourages you to carefully review orders for goods that are either custom-configured to your specifications or customer specific orders. Orders for CTO & CSO goods cannot be modified or cancelled once submitted. Next Byte requires a 100% non-refundable deposit for any CTO goods & CSO goods. Refunds will not be provided on CTO or CSO goods if you simply change your mind.
Software
Due to Copyright and Licensing Laws, Next Byte is unable to accept returns for software if you simply change your mind.
Finance and Leasing
Goods purchased as part of a Leasing or Finance arrangements are unable to be returned without prior approval from the Lessor or financier.
Refunds
Next Byte refunds are processed centrally within 14 days. When returning a product for a refund, you will be asked for your name, address and signature as authorisation for the refund transaction into your back account or credit card.
Next Byte reserves the right to change the terms and conditions of sale at any time.
Contracted Mobile Phones
A ‘contracted’ mobile phone is one where the goods have been purchased as part of a mobile service contract. Purchasing a contracted mobile phone is very different to purchasing a phone outright and is by definition, legally binding.
Please make sure you choose carefully when purchasing a new mobile phone under contract and that you read the contract terms and conditions, plus check the available network coverage where you intend to use your phone (via www.telstra.com.au)
Should you change your mind about your mobile phone after signing a contract, you will need to negotiate a release from Telstra; which may incur an Early Termination Charge.
ESP Express2
For mobile phone products, which are not already covered by a 24-month manufacturer's warranty, ESP Express provides complete peace of mind by extending your manufacturer’s warranty for an additional 12 months. This means your new mobile phone will be covered by a manufacturer’s warranty for 24 months, which is the usual length of a mobile contract. The terms that are generally applicable under a manufacturer's warranty are summarised below.
Protect your phone with ESP Express and gain access to Next Byte’s Express Replacement service in the event you experience a manufacturer’s fault. Your Express Replacement will be provided within 48 hours, ensuring you get maximum value from your Telstra plan.
Please note that you do not need to take up ESP Express in order to receive the benefits of your statutory rights or manufacturer's warranty.
2. ESP Express is not an insurance product, nor is Next Byte an insurer.
Other Situations
If any other situation arises that is not covered by this Policy on Returns, Refunds and Repair, please contact us on 1300 361 119 so we can seek to resolve it immediately.
Statutory Warranties under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
This means you are entitled under this legislation to certain remedies if the goods :
- are of unacceptable quality;
- are not reasonably fit for a purpose which you disclosed to us before buying them; or
- Do not match the description by which they were sold.
The benefits of your manufacturer's warranty and ESP Express are in addition to your statutory rights and remedies. Nothing in this policy limits your statutory rights.
If you require further information in relation to your statutory rights under the Australian Consumer Law, you should contact the Australian Competition and Consumer Commission, or the Office of Fair Trading in your State or Territory.

Prices for products shown on the Next Byte website are shown in Australian dollars and are inclusive of GST. Pricing and products correct at the time of printing. Whilst every effort has been made to ensure the accuracy of the information, Next Byte reserves the right to withdraw or amend at anytime without notice.
